Terms of Use

These terms explain the rules that apply when you visit the Clear Path website or use the secure Clear Path portal.

Clear Path provides secure technology for account resolution. It is not a debt-advice service, lender, debt purchaser or law firm. The company responsible for your case remains responsible for the debt, the information shown and decisions about your account.

1. Who operates Clear Path

Clear Path Resolutions (“Clear Path”, “we”, “us” or “our”) is a software product operated by Handy Digital Ltd. Handy Digital Ltd is registered in Scotland under company number SC792600. Its registered office is 3e Wallace House, Maxwell Place, Stirling, United Kingdom, FK8 1JU.

References to the “case company” mean the organisation that placed your account or case on Clear Path. Its identity and contact information are shown in your invitation and secure portal.

2. What these terms cover

These terms apply to the public website, customer portal and company workspace. Additional terms may apply between you and the case company, between a company user and their employer, or between Handy Digital Ltd and a subscribing company. If those terms conflict with these terms, the relevant contractual or legal terms take priority for that relationship.

By using Clear Path, you agree to use it in accordance with these terms and applicable law.

3. Portal access and security

  • Only access an account or workspace that you are authorised to use.
  • Provide accurate authentication information and keep access details secure.
  • Do not share access codes, passwords or authenticated devices with another person.
  • Tell the case company promptly if information is incorrect or access may be compromised.
  • Company users must follow their organisation’s security and access-control policies.

We may suspend or restrict access where reasonably necessary to protect customers, company data, Clear Path or another person, or where misuse or unauthorised access is suspected.

4. Acceptable use

You must not:

  • attempt to access another customer’s or company’s information;
  • interfere with, probe, reverse engineer or bypass the service’s security controls;
  • upload malicious, unlawful, misleading or infringing material;
  • use automated tools to scrape or overload the service; or
  • use Clear Path for fraud, harassment or any unlawful purpose.

5. Account and case information

Case information is supplied and managed by the case company. Clear Path helps present that information and records actions taken through the portal. Handy Digital Ltd does not independently verify that a debt, balance, deadline, document or contact detail is correct.

If you dispute a debt or believe information is wrong, use the portal’s contact or dispute facility or contact the case company directly. Using the portal does not prevent you from obtaining independent legal or debt advice and does not remove any statutory rights.

6. Proposals, promises and communications

Submitting a proposal, payment promise, message, survey or support request creates a record for the case company to review. A proposal is not accepted until the portal clearly confirms acceptance or the case company confirms it through another authorised channel.

Email, SMS, letters and optional voice calls may be used in connection with a case. Delivery cannot be guaranteed because it may depend on contact details, communications networks and third-party providers. Keep the case company informed of changes to your contact details.

7. Payments and stored payment methods

Card payment pages are provided by Acquired.com on behalf of the relevant case company. Clear Path does not receive or store your full card number or security code. It may retain payment status, amount, date, provider references, a token and limited masked card details so that authorised payments can be recorded or, where you expressly agree, future agreed payments can be taken.

Check the amount and payment type before confirming. Questions about a payment, refund, allocation or balance should be raised with the case company.

8. Availability and changes

We take reasonable steps to keep Clear Path secure and available, but uninterrupted or error-free operation cannot be guaranteed. Access may be interrupted for maintenance, security, provider outages or events outside our reasonable control. We may improve, replace or withdraw features while seeking to avoid unnecessary disruption.

9. Intellectual property

Clear Path’s software, design, branding and original content belong to Handy Digital Ltd or its licensors. You may use the service only for its intended purpose. Case-company branding, documents and case content remain the responsibility of their respective owners.

10. Third-party services and links

Clear Path uses and may link to third-party services, including communications, payments and independent debt-support resources. Their own terms and privacy information apply when you use them. A link does not mean that Handy Digital Ltd controls or endorses all content on an external site.

11. Responsibility and liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. Nothing affects rights that cannot legally be excluded.

Subject to those protections, Handy Digital Ltd is responsible for operating the Clear Path technology with reasonable care and skill. The case company remains responsible for its case data, decisions, legal duties and treatment of customers. We are not responsible for losses caused by inaccurate case-company information, unauthorised use, failure to follow reasonable instructions, or events outside our reasonable control.

12. Privacy

Our Privacy Notice explains how personal information is used, the roles of Handy Digital Ltd and the case company, and your data-protection rights.

13. Changes to these terms

We may update these terms to reflect service, legal, regulatory or security changes. The latest version and its update date will be published here. Material changes may also be highlighted within the service where appropriate.

14. Governing law

These terms are governed by Scots law. If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections provided by the law where you live and may be entitled to bring proceedings in your local courts.
